TERMS OF SERVICE
Last Modified: January 20, 2026Welcome to JobSimple, a service provided by Helix Integrations, LLC (“Company,” “we,” “our,” or “us”).These Terms of Service (“Terms”) govern your access to and use of the JobSimple website, web application, and mobile-optimized tools (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.THIS IS A BUSINESS-TO-BUSINESS AGREEMENT. You acknowledge that JobSimple is designed for commercial use by businesses (e.g., landscaping, pool service, pest control), not for personal consumer use.IMPORTANT NOTICE: ARBITRATION. THESE TERMS CONTAIN A BINDING ARBITRATION PROVISION AND CLASS ACTION WAIVER. IT AFFECTS YOUR LEGAL RIGHTS AS DETAILED IN THE “DISPUTE RESOLUTION” SECTION BELOW.1. Accounts and Registration
1.1 Eligibility You must be at least 18 years old and authorized to bind the business entity on whose behalf you are using the Service.1.2 Account Security You are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized access.1.3 Communications By creating an account, you agree to receive transactional emails (e.g., invoices, password resets) and technical alerts from us.2. Subscription and Billing
2.1 Fees JobSimple is offered for a flat monthly fee (currently $49/month). We reserve the right to change pricing with 30 days' notice.2.2 Free Trial We offer a 3-Month Free Trial. You will not be charged during this period. At the end of the trial, your payment method will be automatically charged the subscription fee unless you cancel.2.3 Automatic Renewal Your subscription will automatically renew month-to-month until terminated. You authorize us to charge your payment method on file at the start of each billing cycle.2.4 Cancellation You may cancel your subscription at any time via the "Settings" page in your account. Cancellation is effective immediately, and you will not be charged for the subsequent month. We do not offer refunds for partial months.3. QuickBooks Integration ("2-Way Sync")
3.1 Authorization By connecting your QuickBooks Online ("QBO") account, you explicitly authorize Helix Integrations, LLC to:Access your QBO customer database, tax codes, and product lists.Create and modify invoices and customers in QBO on your behalf.Query your QBO account to check the payment status of invoices.3.2 Accuracy of Data JobSimple acts as a connector. We are not responsible for:Errors in your QuickBooks books resulting from incorrect data entry in JobSimple.Tax calculation errors. We pass through the tax codes you select, but you are solely responsible for ensuring your tax rates and remittances comply with local laws.Data loss caused by QuickBooks Online outages or API failures.3.3 No Accounting Advice JobSimple is a scheduling and operational tool, not an accounting firm. Use of the QBO integration does not constitute tax or legal advice.4. Payment Processing (Stripe)
4.1 Third-Party Processor We use Stripe, Inc. to process your subscription payments and to allow you to collect payments from your customers ("JobSimple Payments").4.2 Connected Accounts By using JobSimple Payments, you agree to be bound by the Stripe Connected Account Agreement.4.3 Liability Helix Integrations, LLC is not a bank. We are not liable for funds held by Stripe, chargebacks processed by Stripe, or any errors made by Stripe in settling funds to your bank account.5. SMS and Communications (TCPA)
5.1 Your Responsibility The Service allows you to send SMS text messages to your crews and customers (e.g., "On my way" notifications). You are the sender of these messages.5.2 Consent You represent and warrant that you have obtained all necessary consents from your customers and employees to send them text messages via the Service, in compliance with the Telephone Consumer Protection Act (TCPA) and other applicable laws.5.3 Indemnification You agree to indemnify and hold Helix Integrations, LLC harmless from any claims, damages, or fines arising from your failure to obtain consent for SMS communications.6. User Content and Data
6.1 Ownership You retain ownership of the data you enter into the Service (e.g., customer lists, job notes, photos) ("User Content").6.2 License to Us You grant Helix Integrations, LLC a non-exclusive, worldwide, royalty-free license to use, host, store, and display your User Content solely as necessary to provide the Service (e.g., displaying a job note to your crew member, or pushing an invoice to QuickBooks).6.3 Prohibited Content You agree not to upload content that is illegal, offensive, infringing on intellectual property, or contains malware. We reserve the right to suspend accounts that violate this policy.7. Intellectual Property
The Service, including its "JobSimple" name, logo, source code, and design, is the exclusive property of Helix Integrations, LLC. You are granted a limited, non-transferable, revocable license to use the Service for your internal business operations.8. "AS IS" and Limitation of Liability
8.1 Disclaimer THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.8.2 Limitation of Liability IN NO EVENT SHALL HELIX INTEGRATIONS, LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS OR DATA). OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE SIX (6) MONTHS PRECEDING THE CLAIM.9. Indemnification
You agree to defend, indemnify, and hold harmless Helix Integrations, LLC and its officers, employees, and agents from any claims, liabilities, damages, and expenses (including legal fees) arising out of:Your use of the Service.Your violation of these Terms.Your violation of any third-party right (including privacy or intellectual property rights).Your violation of any law (including tax or employment laws).10. Dispute Resolution (Arbitration)
10.1 Binding Arbitration Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.10.2 No Class Actions YOU AGREE THAT YOU MAY BRING CLAIMS AGAINST US ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.10.3 Venue The arbitration shall take place in Tucson, Arizona, and the laws of the State of Arizona shall govern.11. General Provisions
11.1 Assignment You may not assign these Terms without our written consent. Our Service is intended for business owners and professionals. We do not knowingly collect personally identifiable information from children under 13. If we become aware that we have collected Personal Data from a child under 13, we will take steps to delete that information.7. International Data Transfer
JobSimple is based in the United States. If you are accessing the Service from outside the United States, please be aware that your information may be transferred to, stored, and processed by us in our facilities and by those third parties with whom we may share your personal information, in the United States.8.
